Recovering from the riots – claiming for damage to properties

The Department of Communities and Local Government (“DCLG”) has recently announced measures to support the rebuilding of communities following the recent riots.  These measures are to help rebuild damaged buildings, re-open shops and re-house those left homeless.

The Riot (Damages) Act 1886 will assist those who have suffered damage to their properties, or have had their property stolen or destroyed by claiming from the police funds.  There is to be an extra 28 days allowed to those making claims and persons can claim even if they did not have insurance in place.  Insurance companies who pay out for these losses can claim from the police funds.

In addition, there is to be a fund of £10 million made available to assist councils with the immediate costs of clearing up, repairs needed to roads and paths and making the area safe.  To help high street businesses there is to be a £20 million high street support scheme designed to assist with the financing of repairs to buildings and the encouraging customers back.

The costs of providing those left homeless from the riots will be met by established funds already in place.  Action taken to evict social tenants by local authorities found guilty of rioting is welcomed by the DCLG as anti social behaviour and criminal activity is already a discretionary ground for eviction.
