Construction solicitors deliver webinar to scaffolding industry

Earlier this month, Sam Bawden and Lawrence Pearce, specialist Construction Law solicitors from Holmes & Hills’ Construction Team were joined by directors, commercial managers, contract managers, and those responsible for negotiating and agreeing scaffolding contracts and project terms from scaffolding companies nationwide on their inaugural webinar on scaffolding contracts.

The Scaffold Contracts: Negotiations, Services, and Tactics webinar was organised in partnership with the Scaffolding Association of which Holmes & Hills is their national legal partner. However, the webinar was open to all scaffolding establishments across the UK and the virtual room was filled with both member and non-member companies on the day.

Webinar Overview

The 1-hour webinar began with Sam and Lawrence briefing attendees about the contract tactics of main contractors and developers and how to avoid construction disputes.

Specific topics discussed in the webinar included:

  • Understanding the risks and pitfalls when negotiating contracts with main contractors and developers.
  • Highlighting best practice for communicating with main contractors and developers.
  • Summarising what to watch out for when exchanging variations of contracts/terms and conditions (T&Cs) with main contractors and developers.

As well as information on contract tactics, examples were provided of the tactics that Sam and Lawrence have seen main contractors and developers use in an attempt to ensure their terms (which greatly favour their position as opposed to that of the scaffolding contractor) apply. These real-life examples pulled from Sam and Lawrence’s experience within the industry informed those watching to be alive to these tactics when dealing with main contractors and developers in the future in order to avoid contract disputes.

The informative and interactive session was followed by half an hour of Q&A delving deeper into the many issues and disputes faced in real life by the many scaffolding companies in attendance at the webinar.
