Sam Bawden

Sam Bawden

Partner & Head of Litigation Team

Sam is a Partner and head of the firm's Civil Litigation Team and is based at the firm's Sudbury office. Having honed his skills across a broad range of civil and commercial litigation Sam now specialises in acting for clients within the manufacturing and construction industries. Having a particular interest in all types of construction dispute, Sam has significant experience of Adjudication (including enforcement in the Technology and Construction Court), Arbitration, and Litigation in all tracks in the County Court, High Court and Court of Appeal.

He acts for clients at all levels of the contractual chain, from employers to sub and sub-sub-contractors as well as professional consultants, typically dealing with issues such as payment disputes, defects, delay and disruption and professional negligence. Although his background is in dispute resolution, Sam now regularly advises on non-contentious construction matters as well (building contracts, collateral warranties, professional appointments and so on)..

With a keen interest in travelling and languages, it is perhaps no surprise that from the start of his legal career, Sam quickly developed a niche practice in international litigation. Having acted for clients involved in cross border disputes, who are based both within England and Wales as well as those based overseas, Sam has considerable experience of serving English proceedings, and enforcing judgments, outside of the jurisdiction as well as enforcing judgments obtained in other countries within England and Wales.

Recognising the frustration clients feel when they are unable to contact their solicitor, Sam ensures he is accessible to his clients and always aims to respond promptly to client enquiries.

With a very successful past in Thai boxing, Sam continues to train and keep fit and is always on the lookout for that next extreme test of physical endurance.  Always trying to raise the bar, he is known for coercing significant numbers of his colleagues to join him.

Sam is based at Holmes & Hills Solicitors in Sudbury.

What Sam's clients have to say:

"I just wanted you and your firm to know how pleased I was with your work and advice. You listened to my thoughts, queries and worries, guided me in the right direction and were able to take away some of the frustration for me. What I found very comforting was that whilst this was anticipated to be a lengthy and expensive process, your intention was never to carry out then charge me for unnecessary work."

Work highlights

  • Regularly act for business owners defending claims brought against them by a well known business sales agent.
  • Settled a breach of contract/negligence claim brought against a touring company by two American bands (and the touring company’s associated counterclaim).
  • Negotiated an amicable compromise of a claim brought against an individual for specific performance of a contract to sell a residential property.
