In many cases, it is important to understand issues such as “who has the claim?”, “what is the extent of the hereditament?” and “what is the lawful planning use?”, with all the legal issues that flow from that. In simple terms, understanding legal principles and the lawful application of them is tantamount to ensuring that a statutory blight claim, or sale under the shadow of a CPO/DCO, is not unsold or the affected landowner’s interests prejudiced or potential rights/remedies curtailed.

In addition with dealing with the full suite of legal forms and agreements, from claim forms, licence agreement, settlement agreement, non-disclosure agreement, conditional contract, blight notice and other statutory notices through to property transfer form(s), the team can assist and work alongside fellow professionals to provide legal input but, where required, add value to representations and ensure that blight notices and compensation claims are legally compliant and properly served.

Working in Partnership with our client and their professional advisers we can deal with discrete, and typically complicated, legal issues as they arise throughout the life of a CPO or DCO matter and ensure that the client gets the best possible outcome delivered in the most efficient way possible by their professional team.

Where agreement is reached, our specialist residential property lawyer will ensure that a CPO or DCO-related sale (and any associated purchase) is managed in accordance with statutory rules and procedures, to include the recovery and payment of professional costs.
